The Tamil Nadu government has filed a petition in the Supreme Court seeking an order to Governor R.N.Ravi to give his assent to the bills passed in the Tamil Nadu Legislative Assembly within the stipulated time limit, the Governor’s side has informed the Supreme Court. The petition came up for hearing in a bench comprising Justices J.P.Parthiwala and R.Mahadevan.
At that time, the judges questioned whether the Governor can suspend a bill once rejected by the Governor when the government passes it again.
Responding to this, the Governor’s lawyer said that if the bill sent back by the Governor is passed again in the Assembly, it will become a law, and the Tamil Nadu government is indirectly seeking legalization of its bills through the court.
The judges who intervened then asked, under which section did the Governor suspend the bills without taking a decision on them? They also asked, “Is there any other provision for this other than Article 200 of the Constitution?” In response, the Governor’s lawyer replied that the Governor had taken his own decision in this matter.
Stating that it was unacceptable to argue in favor of suspending the bills without any evidence or documents, the judges adjourned the hearing of the case, demanding an explanation from the Governor as to why he suspended the 10 bills.
