The Supreme Court has advised that the Gangster Act should not be applied to individual offences.
Selvaraj was jailed under the Gangster Prevention Act for his involvement in financial fraud. He had filed a petition in the Madras High Court seeking its cancellation. This petition came up for hearing today in the session of Justices SM Subramaniam and V. Shivagnanam.
At that time, with the help of the petitioner, fake bank accounts were opened and fake salary certificates were prepared, through which a loan was obtained from the bank and fraud up to Rs.3.30 crores was committed, police said.
Rejecting the argument in the court that the fraud was carried out with the help of the petitioner, the Anti-Goondat Act was included, the judges said that the Goonda Act should not be used for such individual offences.
Also, the Tamil Nadu government should seriously think about who are thugs, and there should be clarity on who should be registered under the thug law, and the Madras High Court has advised that the general use of the thug law cannot be allowed.
